These Terms and Conditions ("Terms") govern your use of the website https://kenilnfc.com ("Website" or "Service") and the purchase of NFC-enabled products and related digital services (collectively, "Products") offered by KENIL NFC, a service provided by KENILGLOBAL TECH (OPC) PRIVATE LIMITED.

By accessing or using the Service, placing an order, or registering an account, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you may not access the Service or purchase Products.

3. Product Orders, Customization, and Payment

3.1. Custom Orders: All NFC cards are custom-printed and personalized according to your design specifications. We rely on the accuracy of the content and design files you provide. We are not responsible for errors in the final product resulting from inaccuracies in the information or designs provided by you.

3.2. Design Approval: For custom designs, you may be required to approve a final design proof. By approving the proof, you accept responsibility for all elements in the design, including spelling, content, layout, and colour representation (acknowledging that screen colours may differ from final print).

3.3. Pricing and Payment: All prices are listed on the Website and are subject to change without notice. Full payment is required at the time of order placement. We accept various forms of payment as indicated on the Website checkout page, processed through secure third-party payment gateways.


4. Shipping and Delivery

4.1. Production Time: The production and customization of your NFC cards begin only after payment has been successfully processed and the final design proof (if required) has been approved.

4.2. Delivery Commitment: Once production is complete, we commit to shipping your order within the timeframe specified below. The estimated delivery time is: 5 to 14 working days from the date of final design approval and payment confirmation.

4.3. Shipping Delays: The delivery period specified is an estimate. KENILGLOBAL TECH (OPC) PRIVATE LIMITED is not liable for delays caused by third-party shipping carriers, national holidays, strikes, weather conditions, or any circumstances beyond our reasonable control. We will, however, work with you to track your package.

4.4. Risk of Loss: Risk of loss and title for items purchased from the Service pass to you upon our delivery to the carrier.


5. Digital Profile Service and Usage

5.1. Service Provision: The purchase of an NFC card includes the provision of a digital profile management service via https://kenilnfc.com, allowing you to update the information shared by your card.

5.2. Content Responsibility: You are solely responsible for all content, data, graphics, photographs, and other materials (collectively, "Digital Content") you upload and share through your digital profile. You warrant that you have all necessary rights to upload and share this Digital Content.

5.3. Prohibited Content: You agree not to upload any Digital Content that is illegal, defamatory, obscene, pornographic, harassing, discriminatory, or infringes upon any third-party intellectual property rights. We reserve the right to immediately suspend or terminate any digital profile containing such content without notice or refund.

5.4. Profile Access: The digital profile associated with your NFC card is designed for public sharing via NFC tap and/or a QR code/link. You acknowledge that anyone with access to your card or its link can view the shared information.


6. Returns, Cancellations, and Refunds

6.1. Custom Products Policy: Due to the personalized and custom nature of our NFC cards, all sales are final once production has begun. Orders cannot be cancelled, returned, or exchanged except in the case of manufacturing defects or errors on our part.

6.2. Defective Products: If the Product is defective (e.g., card not functioning, manufacturing flaw, or print error not present in your approved design proof), you must notify us at hello@kenilglobal.com within 7 days of delivery. We will, at our sole discretion, offer a replacement or a refund after verifying the defect.

6.3. Cancellation Before Production: If you request an order cancellation before we have started the physical production process, we may, at our sole discretion, grant a full or partial refund, minus any costs incurred for design, digital setup, and payment processing fees.


7. Intellectual Property Rights

7.1. Our Intellectual Property: All content on the Website, including text, graphics, logos, images, design elements, and the digital platform code, is the property of KENILGLOBAL TECH (OPC) PRIVATE LIMITED and is protected by intellectual property laws.

7.2. Your License: You grant KENILGLOBAL TECH (OPC) PRIVATE LIMITED a non-exclusive, royalty-free, worldwide license to use the graphics and content you upload solely for the purpose of manufacturing your NFC cards and providing the digital profile service.

7.3. Indemnity for Content: You agree to indemnify and hold harmless KENILGLOBAL TECH (OPC) PRIVATE LIMITED against any claim, damage, or expense, including legal fees, arising from the alleged infringement of any intellectual property rights resulting from the designs or content you provide to us.


8. Limitation of Liability

In no event shall KENILGLOBAL TECH (OPC) PRIVATE LIMITED, its directors, employees, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any products purchased; or (iv) any errors or inaccuracies in the content you upload to your digital profile.

To the maximum extent permitted by applicable law, the total liability of KENILGLOBAL TECH (OPC) PRIVATE LIMITED for any claim arising out of these Terms shall not exceed the amount you paid for the specific Product or Service that is the subject of the claim.


9. Governing Law and Dispute Resolution

9.1. Governing Law: These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

9.2. Jurisdiction: You agree that the courts in JAIPUR, RAJASTHAN, INDIA shall have exclusive jurisdiction to resolve any dispute arising from or relating to these Terms or the Service.
